Michael Cohen Tape Suggests Team Trump Lied About Karen McDougal

Trump appears to be receiving a dose of his own medicine, having been known for years to record his conversations without permission.

The recording was seized in the FBI raids on Cohen's home and office in April, as a part of the federal investigation into Cohen's business dealings.

Giuliani said no campaign funding was involved in the discussion between Trump and Cohen, who has distanced himself from Trump in recent months as the FBI investigates Cohen's business dealings.

He said the FBI's raid on Cohen's office was "inconceivable", but alleged Cohen's actions were "even more inconceivable" and "perhaps illegal". The discussed payment to AMI ultimately never happened, according to Giuliani. But suffice it to say that when the recording is heard, it will not hurt Mr. Cohen. "And any attempt to spin can not change what is on the tape".

He suggested Cohen's motivation could be that, "if he still entertains the thought that the president might pardon him, the putting of this tape in the public domain is a pressure point on the president that he can do the president great damage".

But if the conversation were recorded in NY, it would probably be legal for Cohen to record it. Cohen's office, which Federal Bureau of Investigation agents raided in April and where the tape reportedly came from, is in NY. "They're talking about a corporation doing it, one of their corporations doing it". Giuliani added that Trump told Cohen that if he did pay McDougal, it should be in the form of a check instead of cash so that it could be properly recorded, The Times said.

The President's lawyer also sought to position the President as wronged by the recording.

He cited two recent cases that show "despite the burgeoning use of surreptitious recordings by members of the public, there is little tolerance for lawyers who - albeit legally - surreptitiously record" other parties without justification.

The tape was reportedly made two months before the election.

"Nothing in that conversation suggests that he had any knowledge of it in advance", Giuliani told The Times. "In the big scheme of things, it's powerful exculpatory evidence".

The New York State Bar Association calls such secret recording unethical.
