Mom suing over baby's death after treatment at ICE facility

The complaint alleges that within a week of entering the detention center in Dilley, Mariee was running a 104-degree fever, coughing, suffering from congestion, diarrhea and vomiting. A few weeks later, and while Marie's situation was getting worse, her mother and her went to live with a family in New Jersey.

On Tuesday, her lawyers filed a notice of claim against the city of Eloy, Arizona, which is the prime contractor for the federal government in operating the Dilley facility. CNN did not receive an immediate response from the city of Eloy to a request for comment on the case. Juarez repeatedly sought health care for her daughter, but didn't get the intensive medical treatment she sought and was prescribed various medication that didn't improve her daughter's condition, according to the timeline.

Arnold & Porter said the legal team is handling this case pro bono and have plans to pursue litigation against ICE and others Mariee's mother is accusing in connection with her death.

Shortly after the two were released, the child was hospitalized for respiratory failure and died at a Pennsylvania hospital in May.

ICE said in a statement that it "takes very seriously the health, safety and welfare of those in our care".

ICE officials released a statement that says it provides comprehensive medical care to everyone in its custody; however, they did not specifically elaborate about the child in question. The two were housed in a room with five other mothers and their children, including one boy who was sick with a respiratory infection. The nurse who discharged Mariee weeks later cleared her for travel without seeing the child, examining her, or taking her vitals.

Mariee died on May 10 after experiencing a catastrophic hemorrhage and "irreversible brain and organ damage with no hope of survival", the claim states; her cause of death was bronchiectasis, pulmonitis, and a collapsed lung. "Mariee died following six agonizing weeks in the hospital after leaving Dilley", according to her lawyers.

ICE also previously said it was "looking into the report of a death after custody".

Texas Department of Family and Protective Services Commissioner Hank Whitman had pleaded for information about the alleged incident during a Texas House of Representatives committee hearing on August 9. Juarez was told by one of the mothers that the boy became ill upon arriving at Dilley and was denied medical care.
