The news release goes on to say that at the June hearing that "Ms. Barzee's attorney contended that Ms. Barzee's federal sentence should run concurrently with her state sentence and therefore the Board had miscalculated the end of Ms. Barzee's state sentence...."

Smart, now 30, didn't immediately have comment.

The parole board had previously denied Barzee an early release after declining to include her eight years in federal prison as time served on state charges. Barzee was sentenced in 2010 to 15 years in federal prison, but got credit as part of a plea bargain for the seven years she'd already spent behind bars in both the Utah State Hospital and Salt Lake County Jail.

Utah Board of Pardons and Parole spokesman Greg Johnson said Barzee will be freed on September 19.

Barzee returned to Utah in 2016 after completing her federal sentence in Texas and began serving her Utah prison sentence. "I am trying to understand how and why this is happened and exploring possible options". "We were told she was getting out in 2022".

In June, the parole board calculated her sentence would continue through January 2024, however that did not account for time served in federal prison.

Brian David Mitchell was sentenced to life imprisonment after being convicted of the kidnapping and unlawful transportation of a minor across state lines to engage in sexual activity.

In November 2009, Barzee pleaded guilty to federal charges.

The couple kept Smart for nine months until authorities found her in walking down a street in Sandy, a suburb of Salt Lake City just 18 miles from her family's residence. The Board counted credit for time served in jail and the state hospital pre-conviction but did not count the time she spent in federal prison as credit to her Utah sentence. He then shackled her to a wire between two trees while Barzee fully cooperated and was complicit in the kidnapping. She's also become an outspoken child safety activist and advocate for stronger laws against those who harm children, even testifying in the U.S. Congress in March 2006 in favor of the AMBER Alert system and tough laws against child predators.
