US federal judge rules Obamacare unconstitutional

The judge ruled that the mandate and the rest of the law couldn't be separated.

'The Individual Mandate can no longer be fairly read as an exercise of Congress's Tax Power and is still impermissible under the Interstate Commerce Clause - meaning the Individual Mandate is unconstitutional, ' the judge wrote.

"The Supreme Court held Obamacare was only tethered to the Constitution by a very thin thread - the fact that the individual penalty raised some revenue", Paxton said in a prior statement.

However, until any appeals process is finished, the act will remain the law of the land, according to White House Press Secretary Sarah Sanders. Once again, the President calls on Congress to replace Obamacare and act to protect people with preexisting conditions and provide Americans with quality affordable healthcare.

A federal judge in Texas ruled on Friday that the Affordable Care Act is unconstitutional, a decision that was likely to be appealed to the Supreme Court.

Meanwhile, Democratic Sen. Chuck Schumer said the ruling "seems to be based on faulty legal reasoning and hopefully it will be overturned". "Americans who care about working families must do all they can to prevent this district court ruling from becoming law".

"Today's ruling is an assault on 133 million Americans with preexisting conditions, on the 20 million Americans who rely on the ACA's consumer protections for health care, and on America's faithful progress toward affordable health care for all Americans", California Attorney General Xavier Becerra said in a statement, Bloomberg reports, adding that a "spokeswoman for Becerra said an appeal will be filed before January 1".

"Today's decision is an unfortunate step backward for our health system that is contrary to overwhelming public sentiment to preserve pre-existing condition protections and other policies that have extended health insurance coverage to millions of Americans", said Dr. Barbara L. McAneny, president of the American Medical Association.
